Terms of Service

Last Updated: February 2026

These Terms of Service (“Terms”) govern your use of VitalCertificates.ca (the “Website”) and any services purchased through the Website. By accessing or using the Website, or by placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, do not use this Website.

1. Services Provided

VitalCertificates.ca provides professional application assistance for individuals requesting Canadian vital records, including but not limited to birth certificates, marriage certificates, and death certificates (“Vital Records”). Our services may include online form preparation, document review for completeness, submission assistance, application tracking, and customer service.

VitalCertificates.ca is a private service provider and does not issue Vital Records. Vital Records are issued solely by the authorized government agency.

2. Operational Support and Fulfillment

To provide the highest level of service and security, VitalCertificates.ca operates under USVitalRecords.org for operational support, customer service, order processing, and fulfillment services.

Customer service, processing, and certain fulfillment functions are managed through the operational systems and support infrastructure associated with USVitalRecords.org.

By using this Website, you acknowledge that your order may be processed under the same administrative standards and operational oversight used by USVitalRecords.org.

3. Relationship to Government Agencies

VitalCertificates.ca is a private, third-party service provider and is not affiliated with the Government of Canada or any provincial, territorial, or municipal government agency. Vital Records can be obtained directly from official government sources.

Our fees are for the value-added professional services we provide and are separate from any mandatory government filing fees.

4. Fees and Charges

The total amount paid through VitalCertificates.ca may include:

  • Government Fees: Mandatory fees required by the issuing authority (where applicable).
  • Service Fees: Fees charged by VitalCertificates.ca for processing, document preparation, handling, and customer service.

VitalCertificates.ca service fees are separate from government fees. Government agencies may offer Vital Records at a lower cost when ordered directly, without the assistance services provided through this Website.

5. Customer Responsibilities

You are responsible for providing accurate and complete information when placing an order. You must be legally eligible to request the Vital Record under applicable Canadian laws and provincial/territorial requirements.

Delays, rejections, or denials may occur if information is incomplete, inaccurate, or required documentation is missing.

6. Processing Times and Delivery

All processing timelines provided on the Website are estimates based on current government turnaround times and are not guaranteed.

VitalCertificates.ca is not responsible for delays caused by government agencies, courier services, incomplete applications, or missing documentation.

7. Cancellations and Refund Policy

Due to the immediate nature of document processing and application assistance services, refunds are limited once work has begun.

Non-Refundable Costs: Government fees and third-party delivery charges cannot be refunded once an application has been submitted to the issuing authority.

Service Fees: In the event of a cancellation request, service fees may be partially refunded at our discretion depending on the stage of processing and work completed.

If your application is rejected or denied due to ineligibility, incorrect information, or missing documentation, VitalCertificates.ca is not obligated to provide a refund.

8. Fraud Prevention and Identity Verification

To protect customer security and comply with legal requirements, VitalCertificates.ca may request additional documentation, including government-issued identification or proof of eligibility.

We reserve the right to cancel or refuse service if fraudulent activity, misuse, or misrepresentation is suspected.

9. Privacy and Data Security

Use of this Website is subject to our Privacy Policy. All personal data is handled using secure administrative procedures and systems designed to protect sensitive customer information.

Certain processing, customer service, and security functions may be performed through operational systems associated with USVitalRecords.org.

10. Disclaimer

VitalCertificates.ca makes no guarantees that a Vital Record request will be approved, accepted, or processed by a government authority. Government requirements and processing times may change at any time without notice.

11. Limitation of Liability

To the maximum extent permitted by law, VitalCertificates.ca and its operational service partners shall not be liable for indirect, incidental, special, or consequential damages arising from the use of this Website or services, including delays or denial by government agencies.

In all cases, our total liability is limited to the amount of the service fees paid for the order in question.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Canada and applicable provincial or territorial laws.

13. Changes to These Terms

VitalCertificates.ca may update these Terms at any time. Updated Terms will be posted to this page with a revised “Last Updated” date. Continued use of the Website constitutes acceptance of the updated Terms.
